Terms of Service

Welcome to AcadKits ("Platform", "We", "Us", or "Our"). These Terms of Service ("Terms") govern your access to and use of our developer tools, containerized web hosting services (AcadSites), digital marketplace (AcadMarket), and cloud utilities across acadkits.dev and tools.acadkits.dev.
1. Eligibility & Account Responsibility
1.1 Age, COPPA & DPDP Act Minor Compliance
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use our Services. Minors between the ages of 13 and 17 may only use the Services under the direct supervision and verifiable consent of a parent or legal guardian who agrees to be bound by these Terms. In compliance with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.), children under 13 years of age are strictly prohibited from creating accounts, providing personal data, or deploying applications. Furthermore, under Section 9 of the Indian Digital Personal Data Protection Act, 2023 (DPDP Act), any processing of personal data of an individual under 18 years of age requires verifiable parental or lawful guardian consent; behavioral monitoring, user profiling, and targeted advertising directed at individuals under 18 are strictly prohibited on AcadKits.
1.2 Sanctioned Entities & Compliance
You represent and warrant that you are not listed on any Indian or international trade restriction or sanctioned party list, and that you will comply with all applicable local, national, and international export control regulations.
1.3 Account Security & Credentials
You are strictly responsible for maintaining the confidentiality of your account credentials (passwords, OAuth tokens, API keys) and for all deployments, bandwidth, and activities executed under your account. Notify us immediately at [email protected] upon discovering any security breach.
2. Prohibited Activities & Acceptable Use
You are strictly prohibited from engaging in, attempting, or facilitating any of the following activities on our platform or hosted containers:
- Malware & Exploits: Hosting, deploying, or transmitting ransomware, rootkits, viruses, keyloggers, or trojans.
- Network Attacks: Launching or participating in Denial of Service (DoS/DDoS) attacks, port scanning, IP spoofing, or WebSocket flooding.
- Crypto Mining: Utilizing container compute resources, serverless functions, or shared workers for cryptocurrency mining.
- Phishing & Scams: Creating fake login pages, impersonating organizations, or harvesting user credentials without authorization.
- Bulk Email Spam: Operating open mail relays, sending unsolicited bulk emails, or executing automated mass messaging bots.
- Illegal Content: Hosting content that violates Indian Penal Code / IT Act 2000, CSAM, non-consensual personal data, or content inciting violence.
- Container Breakouts: Attempting to bypass gVisor sandboxing layer, gain unauthorized host kernel access, or probe hypervisor vulnerabilities.
3. Resource Ceilings & "Zero-Liability Cost Safeguard"
AcadKits enforces tier bandwidth and storage resource caps:
Zero-Liability Cost Safeguard
Unlike traditional cloud platforms that automatically bill your card for unexpected bandwidth overages or traffic spikes, AcadKits operates on a Zero-Liability Cost Safeguard. When your hosted site reaches 100% of its tier bandwidth cap, services will gracefully throttle or temporarily pause until the next billing cycle or an intentional manual upgrade. Under no circumstances will AcadKits trigger surprise overage bills.
4. Anti-Abuse & Immediate Suspension Rights
AcadKits reserves the right to immediately suspend or terminate any container, worker, process, or account without prior notice if our monitoring systems detect active malware execution, outbound DDoS attacks, crypto mining, or severe resource abuse threatening host stability.
5. Limitation of Liability & Governing Law
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAWS (IT ACT 2000):
5.1 COMPLETE EXCLUSION OF LIABILITY FOR FREE TIER (STARTER PLAN)THE FREE FOREVER / STARTER PLAN IS PROVIDED STRICTLY FOR TEMPORARY TRIAL, EVALUATION, AND HOBBYIST PURPOSES ONLY. ACADKITS OFFERS ZERO (0) WARRANTIES, NO GUARANTEES OF UPTIME, AND NO DATA BACKUP ASSURANCES FOR THE FREE TIER. UNDER NO CIRCUMSTANCES SHALL ACADKITS, ITS OWNER, OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES, DATA LOSS, SITE DOWNTIME, OR FINANCIAL LOSSES ARISING FROM THE USE OF THE FREE TIER. NO COMPENSATION, FINE, OR PUNITIVE DAMAGES WILL BE PAID BY US TO ANY USER OF THE FREE TIER.
5.2 LIABILITY CAP FOR PAID PLANS (PREMIUM / UNLIMITED)FOR PAID USERS (PREMIUM AND UNLIMITED PLANS), OUR AGGREGATE LEGAL AND FINANCIAL LIABILITY FOR ANY PROVEN NEGLIGENCE, DATA BREACH, OR SERVICE INTERRUPTION SHALL BE STRICTLY CAPPED AND SHALL NOT EXCEED THE FIXED AMOUNT OF RUPEES ONE THOUSAND ONLY (₹1,000 INR). IN NO EVENT SHALL LIABILITY EXCEED THIS CEILING, REGARDLESS OF THE NATURE OF THE CLAIM.
These Terms are governed by the laws of the State of Gujarat, India. Any legal action shall be subject to the exclusive jurisdiction of the competent courts in Gujarat, India.
6. Subscriptions, Automatic Renewal & Click-to-Cancel
Paid subscriptions (Premium and Unlimited plans) automatically renew on a continuous billing cycle (monthly or yearly) until cancelled.
- Online 1-Click Cancellation: In accordance with California ARL (SB 313) and FTC Click-to-Cancel rules, you can cancel your subscription at any time with 1 click in your Account Dashboard without contacting support.
- No Termination Penalties: Cancellation takes effect immediately to halt future billing; your account retains full paid access until the end of your current paid billing period.
7. DMCA Safe Harbor & Repeat Infringer Policy
All user container deployments and marketplace listings are subject to Title 17 U.S.C. § 512. AcadKits strictly enforces a 3-strike repeat copyright infringer termination policy.

8. Data Principal Duties under the DPDP Act, 2023 (Section 15)
In accordance with Section 15 of the Digital Personal Data Protection Act, 2023(Republic of India), every registered user, developer, and visitor ("Data Principal") is subject to statutory legal duties:
- No Impersonation: You shall not impersonate another individual while registering or providing personal data.
- No Suppression of Facts: You shall not suppress material facts or provide false identity, contact, or billing information.
- No Frivolous Grievances: You shall not register false, malicious, or frivolous complaints with AcadKits or the Data Protection Board of India.
- Authentic Correction Requests: When exercising statutory rights of correction or erasure, you shall furnish only verifiably authentic details.
Breach of Section 15 duties may attract statutory penalties up to ₹10,000 INR under the DPDP Act Schedule, alongside immediate account suspension. Learn more in our DPDP Statutory Notice.
