AcadKits ("AcadKits", "We", "Us") respects the intellectual property rights of creators, developers, and copyright holders. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), Indian Copyright Act 1957, and global copyright treaties, we respond expeditiously to valid notices of claimed infringement across acadkits.dev, tools.acadkits.dev, AcadMarket, and AcadSites container deployments.

2. Notice of Claimed Infringement Requirements (§ 512(c)(3))

To ensure legal validity under 17 U.S.C. § 512(c)(3), your written takedown notice must contain all six (6) of the following elements:

  1. Physical or Electronic Signature: The electronic or physical signature of the copyright owner or person authorized to act on their behalf.
  2. Identification of the Copyrighted Work: A description of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
  3. Exact Location of Infringing Material: Direct URL(s) or specific locator(s) identifying where the infringing material is located on our platform (e.g., https://acadkits.dev/marketplace/product/[slug] or https://[subdomain].acadkits.dev).
  4. Contact Information: Full name, physical mailing address, telephone number, and email address of the complaining party.
  5. Good Faith Statement: A formal statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  6. Perjury & Authority Statement: A formal statement: "The information in this notification is accurate, and under penalty of perjury, that I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
Caution under 17 U.S.C. § 512(f):Any person who knowingly materially misrepresents that material or activity is infringing may be liable for statutory damages, including attorneys' fees incurred by the alleged infringer or by AcadKits.

3. Counter-Notification Procedure (§ 512(g)(3))

If you believe your content or hosted container was wrongfully disabled due to mistake, misidentification, or fair use, you may submit a formal Counter-Notice to [email protected] (Subject: Attn: DMCA Counter-Notice) containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the URL location at which it previously appeared.
  • A statement under penalty of perjury: "I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material."
  • Your name, address, telephone number, and email address.
  • A statement consenting to the jurisdiction of the Federal District Court (for US residents) or competent courts in Gujarat, India (for international users), and that you will accept service of process from the original complainant.

Upon receipt of a valid Counter-Notice, AcadKits forwards a copy to the original claimant. Unless the claimant files a judicial court action within 10 to 14 business days, the disabled material will be restored.

4. Strict Repeat Infringer Policy (§ 512(i)(1)(A))

In accordance with 17 U.S.C. § 512(i)(1)(A), AcadKits maintains an enforced repeat infringer policy:

  • Strike One: First verified DMCA takedown results in immediate removal and formal warning.
  • Strike Two: Second verified infringement results in a 14-day suspension of marketplace selling privileges and deployment capabilities.
  • Strike Three (Permanent Termination): Third verified infringement results in irrevocable account termination, permanent purge of hosted containers and marketplace listings, and forfeiture of marketplace seller accounts without right of reinstatement.

5. Trademark, Trade Secret & Brand Infringement
